Karencja, czyli odłożenie w czasie początku okresu odpowiedzialności ubezpieczyciela z tytułu określonych ryzyk w trakcie trwania umowy ubezpieczenia, jest jedną z konstrukcji prawnych powszechnie używanych w umowach ubezpieczenia. Instytucja ta jest ważna, gdyż m.in. zapobiega nadużyciom w ubezpieczeniach. Polskie przepisy dotyczące ubezpieczeń gospodarczych nie regulują wprost karencji, stąd pojawia się szereg problemów praktycznych, niektóre z nich rozwiązuje orzecznictwo sądowe, uzupełniając przepisy prawa. Celem niniejszego artykułu jest przedstawienie wybranego najnowszego orzecznictwa dotyczącego instytucji karencji oraz niektórych poglądów przedstawicieli doktryny i praktyki.

The grace period, that is, the postponement of the beginning of the period of the insurer's liability due to certain risks during the term of the insurance agreement, is one of the legal structures commonly used in insurance contracts. This institution is important, because, among other things, it prevents insurance fraud. Polish business insurance provisions do not directly regulate the period of grace. Therefore, there are numerous practical problems, some of which being solved by the case law, in addition to the legislation. The purpose of this article is to present selected recent judicial decisions concerning the grace period as well as several views of the representatives of the doctrine and practice.
