Glosa omawia aktualną problematykę uznawania tożsamości narodowej za dobro osobiste. Opracowanie zawiera argumenty wskazujące, że tożsamość narodowa, wbrew stanowisku Sądu Apelacyjnego, nie powinna podlegać cywilnoprawnej ochronie ze względu na niespełnianie konstrukcyjnego wymogu indywidualizacji idealnego interesu oraz brak możności sformułowania wszystkich roszczeń cywilnoprawnych chroniących to dobro. W glosie omówiono również kwestię kultu pamięci osoby zmarłej. Naruszenie komfortu psychicznego nie będzie naruszeniem dobra osobistego, gdy niespełniony jest wymóg indywidualizacji, nie tylko podmiotu, którego dobro osobiste zostało naruszone, ale i osoby zmarłej, co Sąd Apelacyjny powinien przeanalizować.

The commentary discusses the current issue of recognizing national identity as a personal interest. The commentary includes arguments indicating that national identity, contrary to the Appeal Court’s view, should not be subject to civil law protection due to the failure to meet the constructional requirement of individualisation of an ideal interest and the inability to formulate all civil law claims protecting this good. The gloss also presents the issue of the cult of memory of the deceased. Violation of the psychological comfort is not deemed a breach of the personal interest when the requirement of individualisation is not fulfilled, not only of the person whose personal interest has been violated, but also of the deceased, which the Appeal Court should analyse.
