In the subject area of establishing, expanding and burial of the de-ceased the author presents a history of origination of cemeteries and undertakes two significant subjects of a normative nature. First of all, the author demonstrates that existence of a local town and country de-velopment plan for the territory of a cemetery (a parish or communal one) is indispensable, which was certified in its judgements by the Su-preme Administrative Court. This principle results from a provision of art. 3 of act from 1959 on cemeteries and burring the deceased A deci-sion on establishing localisation of a public aim investment seems to be insufficient in this scope. Secondly, the author assumes a thesis that privatisation would be admissible in the filed of establishing, and maintaining the cemeteries after fulfilling adequate conditions by interested private parties. The author tries to prove that such privatisation of a specific character has already taken place in a form of denominational cemeteries.
