W dniu 29 stycznia 2015 r. Sąd Najwyższy wydał postanowienie (I KZP 25/14), po raz pierwszy kompleksowo regulując kwestie związane z dowodowym wykorzystaniem badań poligraficznych w polskim procesie karnym. Rozwiał tym samym wszelkie wątpliwości związane z możliwością przeprowadzenia testów wobec podejrzanego (oskarżonego) lub świadka. Dopuścił opinię biegłego z zakresu badań poligraficznych – zarówno jako dowód odciążający, jak i obciążający. Wynik badania poligraficznego dowodzi jednak wyłącznie tego, jakie były reakcje badanej osoby na poszczególne pytania. Dlatego jest to dowód pośredni, który niczym się nie różni od dowodów z opinii innych biegłych. Sąd zauważył ponadto, że badanie poligraficzne nie może być substytutem przesłuchania, co oznacza, że biegłemu nie wolno wykraczać poza standardowe elementy procedury tego badania.

On 29th January 2015 the Supreme Court issued the judgement (I KZP 25/14) comprehensively regulating for the first time the matter of the usage of polygraph examinations for evidentiary purposes in Polish criminal proceedings. Thereby, the Court dissipated any doubts on the possibility of testing a suspect (an accused) or a witness and stated that a polygraph expert opinion is admissible as incriminating and exonerating evidence as well. However, the result of a polygraph examination proves solely the examinee’s reactions to particular questions. Therefore, this is an indirect piece of evidence that is no different from other expert opinions. Moreover, the Court noticed that a polygraph examination cannot be an alternative to interrogation. This means that experts are not allowed to reach out beyond the standard elements of the polygraph examination procedure.
