W państwach członkowskich Unii Europejskiej nabywanie nieruchomości przez obywateli innych państw członkowskich jest w pełni legalne. Obowiązują tu cztery podstawowe swobody: -przepływu kapitału, -pracowników, -świadczenia usług, -prowadzenia działalności gospodarczej. Szeroko pojmowany rynek nieruchomości wydaje się być coraz częściej postrzegany jako rynek międzynarodowy. W związku z powyższym zasadnym wydaje się traktowanie o zasadach nabywania nieruchomości przez cudzoziemców w innych krajach należących do Unii Europejskiej. Artykuł w sposób syntetyczny oraz bardzo ogólny charakteryzuje warunki formalno-prawne nabywania nieruchomości przez cudzoziemców w Austrii i Portugali. Autorka podjęła próbę przedstawienia najważniejszych aspektów związanych z nabywaniem nieruchomości przez obcokrajowców w wyżej wymienionych krajach.

This article is intended to provide an overview of the most important legal considerations related to real estate transactions in selected jurisdictions and covers Austria and Portugal. The article characterises the main rules regarding acquisition of real estate by foreigners in counties mentioned above. Its purpose is to present property acquisition’s rules by providing legal insight and information necessary for having a general overview on the matter.
