L’autore pone il problema riguardante una certa tensione fra il can. 1684 § 1 e il can. 1644 § 1 del CJC, come del resto fra la verità oggettiva e la verità soggettiva. Alla luce di quella contraddittorietà i compiti del giudice e del tribunale si manifestano più chiaro.
