This study is devoted to the limits of due diligence as a condition for maintaining the right to deduct input tax. The main emphasis has been placed on the issue of the taxpayer’s legal security. When concluding a transaction with an unreliable contractor, bad faith cannot be attributed to the taxpayer in advance, unless the taxpayer has objective reasons to suspect that he could be a participant in practices aimed at abusing the tax on goods and services. The subject of the study is the analysis and assessment of the design features of the above-mentioned due diligence.

Niniejsze opracowanie poświęcone jest granicom należytej staranności jako przesłanki zachowania prawa do odliczenia podatku naliczonego. Główne akcenty zostały położone na problem bezpieczeństwa prawnego podatnika. W momencie zawierania transakcji z nierzetelnym kontrahentem nie można z góry przypisywać złej wiary podatnikowi, o ile podatnik nie ma obiektywnych przesłanek do podejrzewania, że mógłby być on uczestnikiem procederu zmierzającego do nadużyć w podatku od towarów i usług. Przedmiotem opracowania uczyniono zatem analizę oraz ocenę cech konstrukcyjnych tytułowej należytej staranności.
