Prawo ochrony środowiska wykazuje daleko idącą specyfikę jeśli chodzi o przedmiot regulacji, a tym samym – specyfikę regulującej go materii ustawowej. Nasilającą się tendencją jest nie tylko mnogość regulacji podustawowej, ale i zjawisko zaniechania legislacyjnego polegające na niewydaniu obligatoryjnych rozporządzeń wykonawczych. Celem pracy jest ocena możliwości zastosowania analogii jako metody stosowania/wykładni prawa w przypadku braku regulacji podustawowej, określenia warunków dopuszczalności jej zastosowania oraz możliwych skutków takiej analogii. W opracowaniu ujęto także propozycję interpretacji prawa w przypadku niedopuszczalności zastosowania analogii, tj. interpretacji  wątpliwości co do treści normy prawnej na rzecz strony.

Environmental protection law shows far-reaching specificity as regards the subject of regulation, and thus – the specificity of the statutory matter that regulates it. The increasing tendency is not only the multiplicity of sub-statutory regulation, but also the phenomenon of legislative omission consisting in the failure to issue mandatory regulations. The aim of the work is to assess the applicability of analogy as a method of applying/interpreting the law in the absence of statutory regulation, determining the conditions of admissibility of its application and the possible effects of such analogy. The study also includes a proposal to interpret the law in the case of inadmissibility of the analogy, i.e. interpretation of doubts as to the content of the legal norm for the benefit of the party.
