The structural characteristic of value-added tax (VAT) and excise tax is the shifting of responsibility for a tax which, contrary to the law, the other taxpayers have not declared or paid (this being quasi-joint-and-several responsibility). As for VAT, the responsibility is alleviated by the good-faith clause stemming from the judicial decisions of the Court of Justice, which however is not applicable with excise tax. Administrative courts tend, however, to refer to this particular clause on a converse basis by drawing the consequences being negative to the taxpayer from the circumstances corresponding with the lack of good faith within the meaning of VAT.

Cechą konstrukcyjną VAT i akcyzy jest przerzucenie odpowiedzialności za podatek, którego wbrew prawu nie zadeklarowali ani nie odprowadzili inni podatnicy (odpowiedzialność quasi-solidarna). W zakresie VAT odpowiedzialność tę łagodzi klauzula dobrej wiary wynikająca z orzecznictwa TSUE, niemniej nie ma ona zastosowania do akcyzy. Sądy administracyjne odwołują się jednak do tej klauzuli à reburs, wywodząc negatywne dla podatnika konsekwencje z okoliczności odpowiadających brakowi dobrej wiary w rozumieniu VAT.
