Co-ordination of social security systems in the European Union and Brexit

Withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union (Brexit) will defifi nitely bring various consequences in the field of social security. It is therefore worthwhile to analyse its current perspectives from the point of view of the co-ordination of social security in the EU, taking into account in particular the situation of Poles residing in the United Kingdom (as well as, in a comparative and auxiliary manner, of the British residing in Poland) and of their social rights. Therefore, the article synthetically presents the current state of the EU co-ordination of social security systems in this context, focusing on the examples given above. It has been written at a time, when the prospect of a no-deal Brexit starts looming as a distinct possibility. Even though such a lack of agreement between the parties in question might bring adverse consequences for the said rights, appropriate legal changes (in particular to the EU law) have already been prepared to enter into force, and guarantees of preservation of the rights in question have already been formally put forward. Nevertheless, their scope and practical implementation is still dependent on further political decisions.

Proces wystąpienia Zjednoczonego Królestwa Wielkiej Brytanii i Irlandii Północnej z Unii Europejskiej (Brexit) przyniesie z pewnością różnorakie konsekwencje w zakresie zabezpieczenia społecznego. Warto zatem przyjrzeć się perspektywie Brexitu z punktu widzenia koordynacji systemów zabezpieczenia społecznego w UE, w szczególności biorąc pod uwagę uprawnienia socjalne Polaków w Zjednoczonym Królestwie (a także uzupełniająco i porównawczo Brytyjczyków w Polsce). Celem opracowania jest syntetyczne przedstawienie obecnego stanu koordynacji pod tym właśnie kątem. Biorąc pod uwagę czas powstania tekstu, można stwierdzić, że rysuje się możliwość braku formalnego porozumienia w sprawie Brexitu między Unią Europejską a Zjednoczonym Królestwem. Choć taki rezultat negocjacji między stronami trzeba uznać za zdecydowanie negatywny, to jednak stosowne zmiany w prawie UE zostały już przygotowane do wejścia w życie, zaś gwarancje dotyczące omawianych praw zostały formalnie przedstawione. Zakres i sposób ich faktycznego wprowadzenia w życie zależeć będą jednak od rozstrzygnięć politycznych.
