PL

Cechą charakterystyczną umowy brokerskiej jest nieodpłatność dla mocodawcy. Zgodnie z utrwalonym zwyczajem broker wynagradzany jest nie przez swego mocodawcę, ale przez ubezpieczyciela na podstawie innego od umowy brokerskiej stosunku prawnego. Zgodnie z prezentowanym przez autorów poglądem świadczenie mocodawcy w umowie brokerskiej polega na zachowaniu lojalności względem brokera w szczególności na podejmowaniu działań umożliwiających mu uzyskanie kurtażu od ubezpieczyciela oraz na powstrzymywaniu się od działań, które mogłyby w tym przeszkodzić. W konsekwencji wypowiedzenie umowy brokerskiej przez mocodawcę lub odwołanie pełnomocnictwa udzielonego brokerowi bez istotnych powodów może być podstawą roszczeń odszkodowawczych brokera względem mocodawcy.

Characteristic feature of the insurance brokerage contract lies in the fact that it is unpaid by the principal. According to the custom the broker may demand his commission not from the principal but from the insurer on the basis of a different legal relation. According to authors the basic obligation of the principal under brokerage contract is to become loyal to the broker, undertake the actions which make it possible for the broker to acquire the commission and refrain from the actions that could prejudice the broker’s right to the commission. Consequently terminating the brokerage contract by the principal or revoking the power of attorney given to the broker without the important reasons may result with the broker’s claim for damages from the principal.
