Disinheritance in Polish civil law involves depriving individuals entitled to a compulsory share of their rights due to immoral or reprehensible behavior towards the testator. This is a right granted by the legi-slator to the testator to respond to the inappropriate behavior of their descendants, spouse, or parents. One of the main principles of inheritance law is to provide inheritance benefits to those, who have emo-tional ties with the deceased rather than those who disrupt family bonds with their behavior. There is lit-tle doubt about applying disinheritance to adults entitled to a compulsory share since they have full le-gal capacity and emotional maturity, making them responsible for the negative consequences of their ac-tions. The questionable issue may arise when attempting to disinherit minor descendants of the decea-sed, which is related to their limited ability to engage in legal transactions. Furthermore, minors gain experience and emotional maturity as they grow older. As a result, their behawior typically cannot meet any of the grounds for disinheritance.
