On the 15th November 2023 the Polish law maker changed the rules on disclaimer of an inheritance for a minor by the parents. A new regulation, based on sec. 1643 German Civil Code, has been introduced to enable parents to waive the succession without approval by the family court. The paper examines the new Polish rule and the precise conditions under which it can be applied, comparing it with the German prototype.
