Examination of problems of a public administration organ's inde-pendence in issuance of normative acts, in the first place required carry-ing out considerations over a notion of independence of a public ad-ministration organ, which was done on grounds of' opinions given by representatives of the theory of administration and administrative law theory. Then one should concentrate on explanation of a notion of a normative act, which was done, including up-to-date state of legal pro-visions, conceptions doctrine and jurisdiction. An accepted definition of a normative act allowed to consider a basic problem of the article, i.e. the problem of the scope of independence of a public administration or-gan in issuance of normative acts. The analysis showed the meaning of a principle of competence, as well as the meaning of a requirement of having a capacity by an organ authorised to issue a normative act. Fur-ther an influence of the system and legal relations on the scope of the objective independence was discussed, which required presentation of, relevant dependencies ruling in the centralised and decentralised sys-tems. A problem was also perceived concerning a range of supervisory competencies and influence of these competencies on the scope of inde-pendence of a public administration organ in issuance of normative acts.
