Artykuł dotyczy kwestii własności wyników badań, omawiając w tym zakresie pokrótce regulacje krajów europejskich i poświęcając więcej uwagi regulacji krajowej wprowadzonej niedawną nowelizacją prawa o szkolnictwie wyższym. Analiza dotyczy wpływu wyboru pomiędzy modelem własności instytucjonalnej a modelem przywileju profesorskiego na efektywność procesu komercjalizacji, w szczególności na aktywność uczelni w sferze patentowania. Ponadto, w artykule zwrócono uwagę na niejednorodne pojęcie „wyników badań” i związane z tym konsekwencje prawne w kontekście ich ochrony.

The article deals with the issue of ownership of research results, discussing briefl y regulations of European countries. Greater attention has been located to the Polish regulation introduced by the recent amendment to the higher education act. The analysis concerns the impact of the choice between an institutional ownership and professor’s privilege model on the effectiveness of the commercialization process, in particular in the sphere of academic patenting. In addition, the article highlights the heterogeneous concept of “research results” and legal consequences in terms of their protection.
