Swoboda zawierania umów we współczesnym rozumieniu tego pojęcia nie była znana prawu rzymskiemu. W rzymskim prawie obowiązywała tzw. zasada nominalizmu kontraktowego: tzn. strony zasadniczo nie mogły zawrzeć innego kontraktu niż ten, dla którego przewidziana była ochrona procesowa w postaci odpowiedniej skargi (actio). Można jednak stwierdzić, że związanie stypizowanymi wzorcami kontraktów w praktyce mogło być usunięte. W kontrakcie o uratowanie życia chodzi o to, że jedna ze stron otrzymuje coś lub przyjmuje zobowiązanie drugiej strony wobec siebie, ponieważ uratowała ona darczyńcę względnie zobowiązanego przed jakimś aktem przemocy. Kontrakt ten stanowi doskonały przykład na to, w jakim zakresie juryści rzymscy uznawali zasadę swobody umów.

Freedom of contract, as defined today, has not been known in Roman Law. The Roman Law of obligations was determined by the so-called numerus clausus: in general, the parties were not allowed to conclude contracts other than those for which an actio was provided. On the other hand, this limitation could be circumvented with relative ease in legal practice. In the contract to save the life of someone, an individual receives something from another, for saving or having saved the latter from a violent, potentially lethal threat. This kind of contract serves as a good example of how the Roman jurists dealt with the freedom of contract.

Die Vertragsfreiheit, wie heutzutage definiert wird, hat man im römischen Recht nicht gekannt. Im römischen Schuldrecht galt der sogenannte Typenzwang: Die Parteien konnten grundsätzlich keine anderen Verträge abschließen, für die eine actio nicht vorgesehen war. Andererseits kann man feststellen, dass die Typengebundenheit in der Praxis problemlos beseitigt werden konnte. Bei einem Lebensrettungsvertrag bekommt jemand etwas oder verpflichtet sich dem anderen gegenüber, weil der erste den zweiten von einer Gewalt befreit hat. Ferner ist er ein gutes Beispiel, wie die römischen Juristen mit der Vertragsfreiheit umgegangen sind.
