In the public utility area, the self-government of a region is entitled to establish capital commercial and to join them, without any restrictions. While outside the public utility area, self-governments of regions can establish capital commercial companies only if their performance is to consist in the activities listed in Article 13 (2) of the Act on the Regional Self-Government. Therefore the basic issue that determines the possibility to establish a limited liability company or a public company by a self-governmental region is to define and distinguish between public utility area and non-public utility area in the activities of this self-government.
