Przewidziana w przepisie art. 20 ust. 2 ustawy o ubezpieczeniach obowiązkowych, Ubezpieczeniowym Funduszu Gwarancyjnym i Polskim Biurze Ubezpieczycieli Komunikacyjnych instytucja przypozwania ubezpieczyciela w procesie odszkodowawczym, wszczętym przeciwko ubezpieczonemu, umożliwia zakładowi ubezpieczeń uczestniczenie w toczącym się postępowaniu także wtedy, gdy wolą poszkodowanego nie było dochodzenie roszczenia odszkodowawczego bezpośrednio od niego. Kwestia, czy zgłoszona wówczas przez ubezpieczyciela interwencja uboczna ma charakter interwencji samoistnej czy zwykłej nie jest problemem jedynie teoretycznej natury, lecz stanowi źródło ważkich i daleko idących implikacji praktycznych. Od należytego i uprzedniego zakwalifikowania interwencji ubocznej zgłoszonej przez ubezpieczyciela zależy bowiem jego pozycja w procesie. Dowiedziona w artykule niemożność rozciągnięcia powagi rzeczy osądzonej wyroku zapadłego pomiędzy ubezpieczonym a poszkodowanym, przejawiająca się w różnorodności stosunków prawnych łączących ubezpieczonego z poszkodowanym i ubezpieczyciela z poszkodowanym, jak również w niejednolitym (zwykłym) charakterze potencjalnego współuczestnictwa procesowego w razie pozwania ich przez poszkodowanego jednym pozwem, przesądza o braku podstaw do przyjęcia bezpośredniego wpływu tegoż wyroku na sytuację prawną ubezpieczyciela.

Provided for in art. 20 item 2 of the Act on Compulsory Insurance, the Insurance Guarantee Fund and the Polish Motor Insurers' Bureau, the institution of bringing the insurer in a third party action in the compensation proceedings against the insured enables the insurance company to participate in the ongoing proceedings, even if the victim does not claim compensation directly from the insurer. The question whether the secondary intervention notified by the insurer is an intrinsic or ordinary intervention is not only a problem of theoretical nature, but also a source of important and far-reaching practical implications, because the insurer's position in the proceedings depends on an appropriate and prior qualification of the secondary intervention. The inability, proven in the article, to extend the claim preclusion of the judgment made between the insured and injured party, manifesting itself in the diversity of the legal relationships between the insured and the victim and the insurer and the victim, as well as in a non-uniform (ordinary) character of a potential participation in the proceedings in the event of suing them by the victim by means of one petition prejudges about the lack of grounds to accept the direct impact of the judgment on the insurer's legal position.
