Artykuł dotyczy zakazanych przez ustawę o dystrybucji ubezpieczeń relacji między brokerami ubezpieczeniowymi a agentami ubezpieczeniowymi, w szczególności zaś relacjami, które zostały zakazane bez ich precyzyjnego określenia – poprzez wskazanie ich negatywnego skutku dla rzetelności, uczciwości i profesjonalizmu działania dystrybutorów oraz ochrony interesów klienta. Autor wskazuje sposoby rozumienia użytych przez ustawodawcę pojęć służących ustaleniu zakresu zakazu oraz określa przypadki, w których zasadne jest uznanie, że zakaz powiązań nie obowiązuje. Słowa kluczowe: broker ubezpieczeniowy, agent ubezpieczeniowy, dystrybucja ubezpieczeń, powiązania między agentami a brokerami ubezpieczeniowymi, interes klienta.

The present article is devoted to the relationships between insurance brokers and insurance agents which are prohibited by the Insurance Distribution Act, in particular, the connections that have been banned without their precise determination - by indicating their negative impact on the integrity, honesty and professionalism of distributors and the protection of consumer interests. The author presents the ways of understanding the concepts used by the legislator to define the scope of the prohibition as well as specifies those cases in which the ban on the relationships does not apply.
