W artykule przedstawiono ogólną charakterystykę umowy ubezpieczenia na życie z ubezpieczeniowym funduszem kapitałowym. Na podstawie art. 23 ustawy o działalności ubezpieczeniowej i reasekuracyjnej wyodrębniono cechy charakterystyczne tej umowy. W szczególności omówiono poszczególne rodzaje świadczeń głównych tego stosunku zobowiązaniowego oraz zasady ustalania ich wysokości. Analiza zawarta w artykule koncentruje się na elementach inwestycyjnych tego stosunku zobowiązaniowego, ponieważ jest to cecha odróżniająca go od klasycznej umowy ubezpieczenia. W tym zakresie omówiono problematykę ubezpieczeniowego funduszu kapitałowego oraz ponoszenie w tej umowie przez ubezpieczającego ryzyka inwestycyjnego jako elementu przedmiotowo istotnego.

The goal of this article is to present general characteristics of a unit-linked life insurance contract. Characteristic features of this agreement have been identified on the basis of Article 23 of the Insurance and Reinsurance Activity Act. In particular, various types of major benefits of the contractual relationship and the rules for determining their amount have been discussed. The analysis included in the article concentrates on the investment elements of this contractual relationship, because this is a feature that distinguishes it from typical insurance contract. In this respect, insurance capital fund issues have been investigated and the investment risk taken by the policyholder in this contract has been demonstrated as an objectively essential element.
