Opłata prowizyjna jest rodzajem opłaty publicznej i pełni różne funkcje w pol¬skim porządku finansowo-prawnym. Ustawa o poręczeniach i gwarancjach udzielanych przez Skarb Państwa oraz niektóre osoby prawne1 uzależnia możliwość skorzystania z poręczeń i gwarancji Skarbu Państwa od uiszczenia opłaty prowizyjnej, która stanowi dochód gromadzony na rachunku rezerw poręczeniowych i gwarancyjnych w Banku Gospodarstwa Krajowego. Dotychczas w doktrynie powstało niewiele opracowań, które poświęcone zostały analizie tej instytucji, a dodatkowo, również zmiany dokonane w tej ustawie2 potwierdzają aktualność tematu. W opracowaniu autor skupia się na omówieniu instytucji opłaty prowizyjnej od poręczeń i gwarancji udzielanych przez Skarb Państwa z uwzględnieniem podstawy jej wymiaru, wysokości, sposobu naliczania i poboru, zwolnień, a nadto omawia rachunek rezerw poręczeniowych i gwarancyjnych Skarbu Państwa, na którym gromadzone są wpływy z opłaty prowizyjnej, oraz przedstawia wysokość tych wpływów na tym ra¬chunku w latach 2003–2012.

This study presents the institution of fee commission of guarantees and warran¬ties granted by the State Treasury. The fee commission is a kind of public charges and performs different functions in order in the Polish financial-legal system. This issue is particularly relevant to the entry into force of the Act from 6 December 2013 amending the law on guarantees and warranties granted by the State Treasury and other legal per-sons40. These changes were dictated by the need to finance the state budget borrowing requirements. The author also focuses on discussing the issues of guarantees and war-ranties granted by the State Treasury. The new solutions that were adopted in fee commission in the Polish financial-legal system are an expression of the systemic adaptation of the financial institution’s operations in regard of granted guarantees and warranties to the real needs and capabili-ties of the economy and should be an effective tool for financial support coming from the public-law means.
