Borderline personality disorder is one of the mental dysfunctions that causes inability to consensually enter into marriage. It is a disorder that is difficult to diagnose and, at the same time, it occurs more and more frequently in the population. For this reason, the threads related to the occurrence of borderline disorder are also present in the practice of church courts. The subject of the analysis in this article is the jurisprudence of the Roman Rota in cases of nullity of marriage due to defects in matrimonial consent, which were caused by the presence of borderline personality disorder. The analyzed judgments come from 1983-2020. The aim of the analysis is to show the jurisprudence of the Roman Rota, which is to be of practical use to lower courts in adjudicating in cases in which one of the litigants has borderline disorder.

Zaburzenie osobowości typu borderline jest jedną z dysfunkcji psychicznych powodujących niezdolność do dobrowolnego zawarcia małżeństwa kanonicznego. Jest to zaburzenie trudne do zdiagnozowania, a jednocześnie coraz częściej występujące w populacji. Z tego powodu wątki związane z występowaniem zaburzeń z pogranicza obecne są również w praktyce sądów kościelnych. Przedmiotem analizy w niniejszym artykule jest orzecznictwo Roty Rzymskiej w sprawach o nieważność małżeństwa z powodu wad zgody małżeńskiej, które spowodowane były występowaniem osobowości z pogranicza. Analizowane wyroki pochodzą z lat 1983-2020. Celem analizy jest ukazanie orzecznictwa Roty Rzymskiej, które ma mieć praktyczne zastosowanie dla sądów niższych instancji przy orzekaniu w sprawach, w których jedna ze stron procesowych ma zaburzenia graniczne.
