Streszczenie Artykuł omawia kluczowe postanowienia ustawy Dodda-Franka z 2010 r., której głównym założeniem było zwiększenie stabilności systemu finansowego w USA. Szczególną uwagę zwrócono na dwa nowe mechanizmy. Pierwszy dotyczy możliwości uznania przez FOSC instytucji finansowej za systemowo ważną i jako taką – objęcia jej „wzmożonym nadzorem” przez bank centralny USA, tj. System Rezerwy Federalnej. Drugi dotyczy wszczęcia procedury kontrolowanej likwidacji przedsiębiorstwa finansowego, którego kondycja finansowa została przez FSOC uznana za zagrożenie dla stabilności sektora finansowego w USA.

Summary This article discusses the core issues relating to the Dodd-Frank Act of 2010, which was passed to ensure the stability of the financial sector in the United States. Special attention is paid to two new legal mechanisms. Te first relates to the rules and procedures under which the Financial Stability Oversight Council (FSOC) may consider a non-banking finance company important for the stability of the US financial sector. In such a situation the US Central Bank may initiate “supplementary supervision.” The second mechanism involves the controlled liquidation procedure of a financial company which the FSOC considers could disturb the stability of the US financial system.
