Problematyka dotycząca instytucji wywłaszczenia w prawie rzymskim należy do bardzo skomplikowanych i trudnych do zbadania głównie ze względu na brak tekstów źródłowych. Wydaje się jednak, że w Rzymie republikańskim prawo do wywłaszczania, czyli ius publicandi, należało do cenzorów. Kluczowe znaczenie mogła w tym zakresie mieć związana z tym urzędem auctoritas.

The institution of expropriation is one of the most complicated issuesand is difcult to study, mainly because of the shortage of source texts.However, it seems that in republican Rome it was the censors who heldthe ius publicandi, viz. the right to expropriate. The decisive factor couldhave been the authority this magistracy enjoyed.
