The constitutional complaint under review questioned the constitutionality of a provision of the Act on Detective Services which stipulates that a person who in the course of providing detective services performs activities statutorily reserved for state bodies and institutions is liable to a fine. In the opinion of the author, the questioned provision does not violate the principle of definiteness of criminal law provisions. The use of a GPS locator by a detective may be treated as secret acquisition and recording of data contained in computer data carriers. The challenged provision was assessed as conforming to the Constitution.
