The issue discussed in the article is the amended Article 52a of the Code of Criminal Procedure, in force since 15 February 2024. The need to introduce relevant regulations to the Polish law stemmed from the introduction of Directive 2012/29/EU of the European Parliament and of the Council of 25 October 2012 establishing minimum standards on the rights, support and protection of victims of crime, and replacing Council Framework Decision 2001/220/JHA, as well as Directive 2011/93/EU of the European Parliament and of the Council of 13 December 2011 on combating the sexual abuse and sexual exploitation of children and child pornography, and replacing Council Framework Decision 2004/68/JHA. The amended Article 52a of the Code of Criminal Procedure strengthens the procedural guarantees of the aggrieved and witness by obliging the enforcement bodies to make an assessment of the situation with the use of an individual assessment form. The article presents the procedural regulations comprised in Article 52a, as well as legislative deficiencies that may lead to limited application of these solutions in practice.

Przedmiotem rozważań jest znowelizowany art. 52a Kodeksu postępowania karnego, obowiązujący od 15 lutego 2024 roku. Ratio legis przepisu jest wzmocnienie gwarancji procesowych pokrzywdzonego i świadka. Na jego podstawie organy zostały zobligowane do dokonywania oceny sytuacji uczestników postępowania za pomocą narzędzia, jakim jest kwestionariusz indywidualnej oceny. W artykule zostały omówione regulacje procesowe zawarte w art. 52a k.p.k., wskazano także mankamenty legislacyjne, które mogą prowadzić do ograniczenia stosowania tych rozwiązań w praktyce.
