The article deals with the legal framework for macro‑prudential oversight, with particular emphasis to the place and role of the European Systemic Risk Board, (ESRB) its functions and tasks. The author points out that in one of its recommendations the ESRB imposes on Member States the obligation to designate or appoint a body responsible for macro‑prudential policy. In this context, he discusses the draft law on macro‑prudential oversight of the national financial system, evaluating it critically.
