The article presents the definition of the legally determined state budget expenditure and the critical attitude of the science representatives to their increase in recent years. In this context, the development of these expenditure in the fiscal policy and their causes are explained. In the Author’s opinion, the stabilizing expenditure rule and the Multiannual State Financial Plan cannot automatically affect the level and the rationalisation of the legally determined state budget expenditure. Therefore, there is a need of conducting the detailed policy concerning the legally determined expenditure, based on a four-year spending reviews and being reflected in the Budget Bills, reports on the implementation of the state budget and Multiannual State Financial Plans. There is a chance that the principles of such a policy will be prepared by a special team created for this purpose in the Ministry of Finance for the spending review.

The binding Public Finance Act introduces the principle of openness of public funds management (the openness in the narrow sense). It enters as a lex specialis, into the broad principle of public finance openness. The source of the latter is the Constitution and numerous acts. Until now, the science of financial law has focused on the principle of openness in the narrow sense. The aim of the article is to present arguments for the importance of the principle of public finances in a broad sense and the need for its specific protection.

Obowiązująca ustawa o finansach publicznych wprowadza zasadę jawności gospodarowania środkami publicznymi (jawności w sensie wąskim). Wchodzi ona jako lex specialis do szerokiej zasady jawności finansów publicznych. Źródłem tej ostatniej jest Konstytucja i liczne ustawy. Nauka prawa finansowego koncentrowała się dotychczas na zasadzie jawności w sensie wąskim. Celem artykułu jest prezentacja argumentów za wagą zasady finansów publicznych w sensie szerokim oraz koniecznością jej specyficznej ochrony.

Jednym z kluczowych celów sprawozdania specjalnego 01/2019 European Court of Auditors (ECA) w sprawie zwalczania nadużyć finansowych w wydatkowaniu środków UE jest poprawa korelacji między prawem europejskim i prawem wewnętrznym państw członkowskich oraz lepsza współpraca władz unijnych i państw członkowskich w jego realizacji. Po przedstawieniu podstawowych regulacji prawa europejskiego w zakresie zwalczania nadużyć finansowych w wydatkowaniu środków UE zaprezentowano ocenę działań organów UE (zwłaszcza Komisji) oraz propozycję zaleceń sformułowanych przez ECA. Zróżnicowaną sytuację w zakresie zwalczania nadużyć finansowych w wydatkowaniu środków UE w poszczególnych państwach członkowskich przedstawia przykład Polski. One of the essentials aims of the ECA’s special report on fighting fraud in spending EU funds is improving the correlation between the European Union law and national legal systems of Member States and developing cooperation of EU authorities with Member States in its implementation. The first part of the article describes the basic regulations of the EU law on fighting against financial fraud in spending EU budget funds. In the second part, the assessment of operations of the EU bodies (especially the European Commission) and suggested recommendations are presented. The example of Poland describes a diversified situation in the matters of fighting financial fraud in the EU spending in particular Member States.
