The aim of this article is to present the origins of Mortgage Law Act adopted on Polish territory in XIX century. It outlines main characteristics of law regulations and shows the impact on legislation in neighbouring countries.

Celem niniejszego artykułu jest scharakteryzowanie regulacji hipotecznych ustanowionych w XIX w. na terenie Królestwa Polskiego. W publikacji zostanie przedstawiona geneza powstania hipoteki w starożytnych europejskich ustawodawstwach Rzymu i Grecji. Autorka pochyli się także nad instytucją hipoteki w wiekach średnich oraz przedstawi jedną ze słynniejszych ustaw w XVI wiecznej Europie - ustawę o ważności zapisów z 1588 r., będącą genezą podstawowych założeń prawa hipotecznego z XIX w.
