The aim of the study is to analyse the institution of civil law – transmission servitude and its understanding by the Highest Court of the Republic of Poland, shown in the jurisdiction of that Court. The authors study each judgment of the Highest Court, which present the Court’s understanding of that institution. The rulings are subject to constitutional control. The courts of law in Poland issued a couple of legal questions to the Polish Constitutional Tribunal, in which the courts inquired if this understanding of transmission servitude is compatible with the constitution. The authors describe the consequences of the Tribunal’s in the context of the Constitution of Republic of Poland.

The article is intended to outline the development of central banking in terms of its independence, with particular emphasis on the implementation of the idea of an independent central bank in Poland, also comparison with some other countries. The idea of central-bank independence was presented from personnel, financial and functional perspectives. In the initial phase of their development, central banks were mainly established in the form of capital-based companies. Their position and importance was determined by special privileges. The Maastricht Treaty was a normative act that had a major influence on the shape of the currently dominant concept of an independent central bank, which pursues a free monetary policy at its own discretion. The Constitution of 1997 and the Act 29 August 1997 on the National Bank of Poland of were crucial in guaranteeing the strong position and independence of NBP from state authorities.

Artykuł ma na celu przybliżenie rozwoju bankowości centralnej w zakresie niezależności, ze szczególnym uwzględnieniem implementacji idei niezależnego banku centralnego w Polsce oraz na tle innych wybranych krajów. Sposób charakteryzowania niezależności banku centralnego został przeprowadzony pod wymiarem personalnym, finansowym oraz funkcjonalnym. W początkowej fazie rozwoju banki centralne były przeważnie powoływane w formie spółek kapitałowych. O ich pozycji i znaczeniu decydowały specjalne przywileje. Aktem normatywnym, który miał kluczowy wpływ na kształt współcześnie dominującej koncepcji niezależnego banku centralnego, prowadzącego swobodną politykę pieniężną wedle własnego uznania, był Traktat z Maastricht. W Polsce kluczowa stała się Konstytucja z 1997 r. oraz ustawa o NBP z 29 sierpnia 1997 r., które zagwarantowały silną pozycję i niezależność NBP względem organów państwa.

The article aims at compliance with the principles of central banking in terms of independence, with particular reference to the implementation of the independent central bank in Poland and against other selected countries. How to monitor characteristics, central mode of operation and functionality. In the early stages of development, central banks were generally considered in the form of value systems. Their privileges and positions were determined. The Maastricht Treaty was a legal act that had a key influence in shaping today’s dominant concept of an independent central bank, which pursued free monetary policy at its sole discretion. In Poland key legal acts became the 1997 Constitution and the NBP Act of 29 August 1997, which guaranteed the NBP’s strong position and independence.

The study attempts an analysis of the relationship between the concepts of state and nation sovereignty. The thesis has been proposed that state sovereignty could be regarded as a derivation of nation sovereignty. While attempting to approve of the proposed thesis, the authors describe the relationship between both institutions by referring to their origins. In the light of concepts of sovereignty, the relationship between state and international law is presented from a philosophical perspective. Approving the proposed thesis, the authors conclude that regardless of whether state sovereignty derives from nation sovereignty or not, the two concepts refer to different backgrounds which can be seen both in their origins and contemporary realities.
