Błędem medycznym jest naruszenie zasad wiedzy lekarskiej przez lekarza, którego skutkiem jest nierozmyślne uszkodzenie ciała. Często skutkiem błędów medycznych jest niepełnosprawność dziecka. Z tytułu popełnienia błędu medycznego lekarz ponosi odpowiedzialność cywilną, karna i dyscyplinarną. Natomiast podmiot leczniczy może ponosić bowiem odpowiedzialność odszkodowawczą zastępczą za zawinione wyrządzenie szkody przez zatrudnionych w nim lekarzy. Lekarz ani podmiot leczniczy nie ponosi natomiast odpowiedzialności w przypadku niepowodzenia w leczeniu.
