The proposed paper offers a selection and an analysis of CJEU case law on copyright law. As regards the recent and most discussed judgments of CJEU, the author focuses on the evolution of the harmonized copyright law at the EU level: from a specific harmonisation centred on particular normative institutions to a functional interpretation of copyright law regulations. The paper is divided into three main parts: the first part focuses on the analysis of copyright subject matter; what then follows is the analysis of the scope of rights, in particular the right to make a work available online (second part), and, ultimately, there is a third part that deals with copyright limitations and exceptions. The analysis ends with the conclusions and topics for discussion with regard to the future interpretation of EU copyright law.

Opracowanie przedstawia rozważania na temat pojęcia utworu w prawie autorskim, aczkolwiek – dla ograniczenia tematyki – z perspektywy prawa unijnego: orzecznictwa TS UE oraz planowanych zmian, w tym wprowadzanych w projekcie dyrektywy w sprawie Jednolitego Rynku Cyfrowego. Rozważania poświęcone są, po pierwsze, różnicom w rozumieniu pojęcia utworu w systemie prawnym UE oraz w państwach członkowskich; po drugie, poszukiwana jest odpowiedź na pytanie o dopuszczalność oraz zakres harmonizacji pojęcia utworu; po trzecie, podjęta zostanie próba odpowiedzi na pytanie, w jakim kierunku zmierza prawodawca unijny w odniesieniu do konstrukcji utworu.

The above article presents considerations regarding notion of a work in copyright law, however – to limit the scope of the discussion – solely from the perspective of the EU law: in particular, against the background of the CJEU’s jurisprudence and planned amendments in copyright law, particularly on the basis of the Commision’s project on digital single market. The article includes, firstly, the discrepancies in interpretation of work within the legal systems of the EU Member States and the EU legal framework itself, secondly, it also researches for an answer to the question on the legal basis of harmonisation the work concept in copyright law. Thirdly, the author attempts to answer question what is the direction of future legislation of the EU legislator in regard to the work concept in copyright law.
