Characterizing the German legal language at a syntactic level, the researchers point to the frequent use of structures called light verb constructions (Ger. Funktionsverbgefüge). The article attempts to present this phenomenon in the context of legal translation into Polish. The theoretical part includes the characteristics of a formal verbal phrases syntax and a description of their syntactic and semantic properties. The empirical part presents the analysis of dictionary equivalents and equivalents which appear in the Polish translation of the selected two German acts of law. The article focuses on translation solutions in order to formulate general conclusions concerning potential solutions for Polish translation of these constructions.

Charakteryzując niemiecki język prawny na płaszczyźnie składniowej, badacze wskazują na częste użycie konstrukcji zwanych zwrotami werbo-nominalnymi (niem. Funktionsverbgefüge). Artykuł stanowi próbę zaprezentowania tego zjawiska w kontekście przekładu tekstów prawnych na język polski. Część teoretyczna obejmuje charakterystykę formalną werbalnych fraz składniowych oraz opis ich właściwości składniowych i semantycznych. W części empirycznej została przeprowadzona analiza ekwiwalentów słownikowych, a następnie przekładowych zastosowanych w wybranych przekładach niemieckich tekstów prawnych na język polski w celu sformułowania ogólnych wniosków dotyczących potencjalnych rozwiązań translacyjnych dla tych konstrukcji w języku polskim.

The penal law, in contrast to other branches of law, such as the labour law or the family law, doesn’t regulate any sphere of social life, but protects goods and values regarded as most important by a given society. The perpetrator who violates regulations of the penal law is liable to the most severe sanctions, namely, loss or limitation of the most important human values like freedom, property or good name. The present article addresses selected terms of the Polish penal law with reference to their equivalents in the German system. The article begins with the presentation of the system of penalties and penal means in the Polish penal code and its comparison with the system being legally binding in Germany. This is followed by an analysis of the equivalents from a selected Polish-German dictionary and of translation solutions in the German translation of the Polish penal code.

Prawo karne w odróżnieniu od innych gałęzi prawa nie reguluje określonej sfery życia społecznego, jak np. prawo rodzinne czy prawo pracy, lecz chroni dobra i wartości uznawane przez dane społeczeństwo za najważniejsze. Sprawcy naruszającemu normy prawa karnego grożą najdotkliwsze sankcje, a mianowicie utrata lub ograniczenie dóbr wysoko cenionych przez każdego człowieka, jakimi są wolność, wartości majątkowe czy dobre imię. Przedmiotem artykułu są wybrane pojęcia polskiego prawa karnego w kontekście przekładu tekstów prawnych na język niemiecki. Na wstępie zostanie przedstawiony system kar i środków karnych przewidzianych w polskim kodeksie karnym w porównaniu z systemem obowiązującym w Niemczech. Na tej podstawie zostanie przeprowadzona analiza ekwiwalentów zaproponowanych w wybrany słowniku prawniczym polsko-niemieckim oraz rozwiązań translatorskich zastosowanych w przekładzie polskiego kodeksu karnego na język niemiecki.

The article is devoted to the problem of the changes taking place in legal language, among others under the influence of the dynamic political and social situation. The paper will present lexical and semantic changes that have taken place over the centuries in the specialized vocabulary of the Polish and German criminal law. The analysis will be carried out on the example of selected Polish and German legal terms and expressions.

W artykule zostaną przedstawione zmiany leksykalne i znaczeniowe, jakie dokonały się na przestrzeni wieków w słownictwie specjalistycznym polskiego i niemieckiego prawa karnego. Analiza zostanie przeprowadzona na przykładzie wybranych polskich i niemieckich terminów i wyrażeń prawnych.

Der Artikel ist der Frage der Veränderungen gewidmet, die u. a. unter dem Einfluss der dynamischen politischen und sozialen Situation in der Rechtssprache erfolgen. Im Artikel werden lexikalische und semantische Veränderungen präsentiert, die sich im Laufe der Jahrhunderte im Fachwortschatz des polnischen und des deutschen Strafrechts vollzogen haben. Die Analyse wird am Beispiel der ausgewählten polnischen und deutschen Rechtstermini und -ausdrücke durchgeführt.
