There are no doubts about the view that the applicable law should guarantee safety and a sense of justice in the society. Providing these values requires from prearranged normative regulations to take into account all factors, including those from the other fields that are associated with them. Sanity as well as its presumption undoubtedly count among the issues that go directly beyond the plane of law. To consider whether use of the presumption of sanity in a perpetrator of a criminal act is proper in the Polish criminal procedure there is a need for an in-depth analysis of sanity, insanity construction, as well as of factors affecting deprivation of the perpetrator of an abi-lity to recognise importance of the act or to direct their conduct. Giving consideration to this field will make it possible to obtain arguments justifying the adoption of a critical attitude towards the presumption of sanity of the perpetrator.

Nie wzbudza wątpliwości stanowisko, iż obowiązujące przepisy prawa powinny gwarantować bezpieczeństwo i poczucie sprawiedliwości w społeczeństwie. Zapewnienie wspomnianych wartości wymaga od ustanawianych regulacji normatywnych uwzględnienia wszelkich czynników, również tych z innych dziedzin nauki, które są z nimi związane. Poczytalność, a także jej domniemanie bez wątpienia należą do zagadnień wykraczających bezpośrednio poza ramy płaszczyzny prawa. Rozważenie słuszności stosowania obowiązującego w polskiej procedurze karnej domniemania poczytalności sprawcy czynu zabronionego wymaga dokonania dogłębnej analizy niepoczytalności, jej konstrukcji oraz czynników mających wpływ na pozbawienie sprawcy czynu zabronionego zdolności rozpoznania jego znaczenia lub pokierowania swoim postępowaniem. Poczynienie rozważań w omawianym zakresie pozwoli na uzyskanie argumentów uzasadniających przyjęcie krytycznej postawy wobec przyjmowania domniemania poczytalności sprawcy czynu zabronionego.

This article was a commentary on the judgments of the Regional Court and Court of Appeal, issued in the case of marriage annulment brought by M. Z. against J. Z., where the defendant had suffered from paranoid schizophrenia and hid this fact from her future husband. The publication contained arguments questioning the validity of the decision issued by Court of First Instance. In addition, the article set forth premises approving of the ruling of Court of Second Instance.

Niniejsza glosa stanowi komentarz do orzeczeń Sądu Okręgowego i Apelacyjnego wydanych w sprawie o unieważnienie związku małżeńskiego z powództwa M. Z. przeciwko J. Z., w wyniku zawarcia go z pozwaną chorą na schizofrenię paranoidalną, która ukryła ten fakt przed przyszłym mężem. Przytoczono argumenty podające w wątpliwość słuszność rozstrzygnięcia wydanego przez Sąd I Instancji oraz zaprezentowano przesłanki potwierdzające trafność orzeczenia Sądu II Instancji.

The pages of this publication attempt to take into account various factors that may affect the state of inebriation or intoxication of man. States depriving individual impact on their own action were also presented in the field of drug use high-grade products, as well as the capacity reduction that recognise the importance of the act or direct proceedings under their influence was predicted. Stressors were classified according to their severity in relation to the issue of the article. Mental disorders were listed that appear in response to a traumatic event. Symptoms of acute stress and its relationship with the person’s behaviour were shown. It highlighted the doubts that arise on particular issues. The possibility of settlement was signalled. At the conclusions, explored issues were summarized.

This article is a commentary on the court decisions made in connection with the factual situation regarding the admission of a patient to a psychiatric hospital without their consent. In relation to the circumstances found in the case, conditions determining the acceptability of admission to a psychiatric hospital with no consent were discussed under legal regulations contained in art. 23 and 24 of the mental health act. The publication presented arguments for the rightness of providing people with healthcare services, in some circumstances without their consent.

Niniejsza glosa stanowi komentarz do orzeczeń sądowych zapadłych w związku ze stanem faktycznym dotyczącym przyjęcia pacjentki do szpitala psychiatrycznego bez jej zgody. W odniesieniu do zaistniałych w sprawie okoliczności omówiono przesłanki warunkujące dopuszczalność przyjęcia osoby do szpitala psychiatrycznego bez jej przyzwolenia na to, opierając się na regulacjach prawnych zawartych w art. 23 i 24 ustawy o ochronie zdrowia psychicznego. W publikacji przedstawiono argumenty przemawiające za słusznością udzielania niekiedy świadczeń opieki zdrowotnej jednostkom społecznym bez uzyskania ich zgody.

The publication is concentrated on the use of direct coercion in psychiatry. I tried to answer on the question whether using direct coercion always leads to the limitation of individual autonomy, whether provides the protection of constitutional law and human freedom. Unraveling above background would be impossible without refer to the human rights which is a source of basic laws and freedom. The reference to limitation of individual autonomy was based on Bioethical Convention. Situation and requirements became closer which explain and can create a foundation for using a direct coercion. In this article, circumstances were intorduced in which in compliance with law, using direct coercion is acceptable as well as rules and the course. The relationship was noticed between its application and required agreement of individual to grand the health care.
