Nowe regulacje prawne z zawarte w dyrektywie 2014/24/WE z dnia 26.02.2014 r. w sprawie zamówień publicznych oraz w znowelizowanej ustawie Pzp zawierają rozwiązania na rzecz szerszego uwzględniania celów społecznych w procesie udzielania zamówień publicznych. Jednym z nich jest horyzontalna klauzula społeczna. Ustanawia ona zasadę poszanowania stosownych obowiązków w zakresie ochrony środowiska, przepisów socjalnych, a także prawa pracy wypływających z prawa unijnego, prawa krajowego, układów zbiorowych lub prawa międzynarodowego, przy czym niniejszy artykuł koncentruje się na aspekcie związanym z przestrzeganiem przepisów z zakresu prawa pracy na poszczególnych etapach postępowania o udzielenie zamówienia publicznego, a dotyczących weryfikacji braku podstaw do wykluczenia, opisu przedmiotu zamówienia, badania i oceny ofert pod kątem rażąco niskiej ceny.

The new regulations of the directive 2014/24/EU of 26 February 2014 on public procurement and the amended Public Procurement Act include solutions for a broader consideration of social goals in the procurement process. One of them is the Cross-cutting ‘social clause’ based on respecting applicable environmental, social or labour law obligations under EU and national rules, collective agreements or international law. The article focuses on aspects related to the compliance with labour law at various stages of public procurement procedure, and on the verification of the absence of grounds for exclusion, the description of the public procurement’s subject , research and evaluation of tenders for abnormally low prices.

The article presents the concept of execution of power and attitude of Josef II to reforms, focusing on selected administrative, court, and civic reforms. The new concept of legislation is explained together with the function that law is to play, and reforms in civil and criminal law are discussed. The article closes with a recapitulation of the most crucial results of the reforms conducted during the reign of Josef II.

Der Autor befasst sich mit dem Konzept der Machtausübung und präsentiert seine Haltung den Reformen von Josef II. gegenüber. Im Artikel wird die neue Idee der Rechtsformung und der Funktionen des Rechts näher dargestellt. Auch die Reformen des Zivilrechts und des Strafrechts werden hier besprochen. Zum Schluss bringt der Autor die Ergebnisse der unter der Herrschaft von Josef II. vollbrachten Reformen zusammen.

The aim of the paper is to discuss a new kind of provisions in the Polish legal system, that is the episodic provisions. The provisions in question were regulated in the recently amended Rules of Legislative Drafting (Zasady Techniki Prawodawczej in Polish), which went into force on March 1st, 2016. The episodic provisions can raise some theoretical questions and cause various practical problems, both for legislators and interpreters. The authors identify and clarify some of those.
