Samorząd lokalny (gminy, powiaty) odgrywa wiodącą rolę w zapewnieniu obywatelom usług publicznych. Zgodnie z konstytucyjną zasadą samodzielności, samorządom przysługuje szeroka swoboda wyboru metod świadczenia usług publicznych. W szczególności mogą wybierać między zapewnieniem usług poprzez podmioty wewnętrzne oraz kontraktowaniem na zasadach komercyjnych albo na rzecz organizacji pozarządowych. Autor prezentuje pogląd o potrzebie ustawowego zagwarantowania, że decyzje samorządów co do wyboru wariantu zapewnienia usług publicznych (prowadzenia gospodarki komunalnej) będą poparte analizą mającą na celu wybór metod najbardziej efektywnych pod względem ekonomicznym i społecznym. Analiza wykorzystująca dane ilościowe i jakościowe powinna być prowadzona nie tylko przed podjęciem decyzji o wyborze określonej metody prowadzenia gospodarki komunalnej, ale stale, również po zakończeniu świadczenia usług w określony sposób. Ważnym elementem procesu decydowania o wyborze modelu zapewnienia usług publicznych powinny być szerokie gwarancje partycypacji społecznej. Obecnie decyzje władz lokalnych w tej kwestii nie muszą być poprzedzone refleksją nad optymalnymi wariantami zapewnienia usług i mogą być intuicyjne. Nie są też wymagane konsultacje społeczne ani inne formy angażowania interesariuszy w proces decyzyjny. Jako przykład takiego podejścia zaprezentowano brytyjski model Best Value (Najwyższa Wartość) wprowadzony przez rząd T. Blaira.

Local government (municipalities, counties) plays a leading role in public services provision in Poland. In accordance with the constitutional principle of self-government’s autonomy, local governments enjoy extensive freedom to choose methods of public services delivery. In particular, they can choose between providing services through their own units (in-house delivery) and contracting out to commercial entities or NGO. The author argues that there is a pressing need for a statutory safeguards that the decisions of local governments on the choice of variant to provide public services will be accompanied with the analysis aimed at selection most effective and efficient methods of public services delivery. Such analysis, employing both quantitative and qualitative data should be conducted not only before selection of specific methods of municipal services provision, but on regular basis and when the provision of services in a certain way is over (ex ante and ex post evaluation). An important part of the process of deciding on the choice of the model to provide public services should be wide guarantees of public participation. Currently, decisions of local authorities in this matter does not require any reflection on the optimal variants to provide services. As a result, the may be purely intuitive. They also do not require public consultation or other forms of stakeholder engagement in decision-making. As an example of the approach to this issue, suggested by the author the British model of Best Value introduced by Blair’s government was presented.

W opracowaniu przedstawiono brytyjską metodę Best Value jako jedną z najskuteczniejszych w doskonaleniu usług publicznych. Prezentacji dokonano w układzie: geneza metody, jej miejsce w nowym zarządzaniu publicznym, założenia aplikacyjne, w tym definicja wartości i strategii jej zwiększania, oraz metodyczne aspekty stosowania. Osobnym punktem opracowania jest zestawienie opinii na temat efektów Best Value, będących pochodną doświadczeń angielskich. Tekst kończy opis ograniczeń badania, wyznaczenie kierunków przyszłych analiz oraz wstępna ocena przydatności tej metody na gruncie krajowym.

In the article, the English Best Value system is described as one of the more effective frameworks for public services improvement. The authors present the system in the following way: they describe its genesis and its place in the New Public Management concept, discuss the assumptions regarding its application, including the definition of value, the strategies of its increase, and methodological aspects of its implementation. They also compile opinions on the effects of the Best Value regime, and conclude with a statement on the limitations of their research, a discussion of future directions of analysis, and an attempt to evaluate its usability in the Polish context.
