W artykule omówiono rozwiązania przyjęte przez projekt ustawy o dystrybucji ubezpieczeń z dnia 22 marca 2017 r. implementującej dyrektywę Parlamentu Europejskiego i Rady (UE) 2016/97 z dnia 20 stycznia 2016 r. w sprawie dystrybucji ubezpieczeń, w zakresie praktycznych skutków i wyzwań dla prowadzonej przez brokerów ubezpieczeniowych działalności w związku z koniecznością dostosowania do nowej rzeczywistości prawnej. Autor wskazuje przede wszystkim na konsekwencje utrzymania podmiotowego podziału pośrednictwa, nałożenia rozbudowanych obowiązków w zakresie identyfikacji potrzeb klientów, obowiązków informacyjnych zmierzających do zapobiegania konfliktom interesów czy też nowego zdefiniowania rekomendacji brokerskiej. Przedstawia również obowiązki w zakresie doskonalenia zawodowego pośredników ubezpieczeniowych.

The article discusses solutions adopted by the draft law on insurance distribution of 22 March 2017 implementing Directive 2016/97 of the European Parliament and the Council of 20 January 2016 on insurance distribution, in terms of practical implications and challenges for insurance brokers’ activity due to the need to adjust to the new legal reality. It mainly indicates the consequences of maintaining a subjective division of mediation, imposing extensive obligations for identifying customer needs, information requirements aimed at preventing conflicts of interest and a new definition of broker recommendation. It also outlines requirements for the professional development of insurance intermediaries.
