Przedmiotem niniejszego artykułu jest przedstawienie nowej ustawy o prawach konsumenta uchwalonej w dniu 30 maja 2014 r., która wchodzi w życie w dniu 25 grudnia 2014 r., w kontekście umowy ubezpieczenia i skutków, jakie nowa ustawa rodzi w obrębie praw i obowiązków stron w konsumenckiej umowie ubezpieczenia. W związku z faktem, że ustawa ta stanowi implementację acquis communautaire do polskiego porządku prawnego, a więc jest emanacją ewolucji, jaką przeszła ostatnimi laty polityka Unii Europejskiej w sferze ochrony konsumenta, najpierw przedstawione zostaną tendencje europejskie w tej dziedzinie, aby następnie przyjrzeć się bliżej polskiemu sposobowi jej implementacji i jego wpływowi na kształt umowy ubezpieczenia.

The subject matter of the article is a presentation of the new Act on Consumer Rights enacted by the Parliament on 30 May 2014, which comes into force on 25 December 2014 in the context of an insurance contract and consequences which the new Act may have on the parties’ rights and obligations in the ‘consumer’ insurance contract. Having in mind the fact that the new Act is the implementation of the acquis communautaire to the Polish legal system, it is useful to present first the evolution of the EU legislation and the approach to the consumer protection strategy as well as the current tendencies in this respect. Secondly, different aspects of insurance contract included in the new Act are analyzed in order to assess the practical impact of this law, in particular on the scope of information duties and the right of withdrawal from the insurance contract.
