REGULACJE PRAWNE DOTYCZĄCE WYKORZYSTYWANIA KOMÓREK MACIERZYSTYCH ORAZ HYBRYD CYTOPLAZMATYCZNYCH W WYBRANYCH KRAJACH EUROPEJSKICH

The aim of this article is to analyse the legal regulations on the use of stem cells in selected European countries, in the light of research conducted on stem cells of various origin: embryonic, from cytoplasmic hybrids, and from induced pluripotent stem cells. I present the current Polish legislation and discuss the legal regulations in Italy, Spain, Germany, Austria, the Czech Republic, Bulgaria, Sweden, Denmark, Finland, the United Kingdom, France, and Hungary. The countries I have selected for my study have different legal regulations on the possibilities for research – from a restrictive ban, through conditional permission for the use of embryos, cytoplasmic hybrids or induced pluripotent stem cells, to the introduction of comprehensive regulations into the given country’s legal system.

Przedmiotem publikacji jest analiza rozwiązań regulacji prawnych w wybranych państwach europejskich w zakresie badań przeprowadzanych przy użyciu komórek macierzystych o różnym pochodzeniu: z embrionów, hybryd cytoplazmatycznych oraz indukowanych pluripotencjalnych komórek macierzystych. Artykuł przedstawia obecną sytuację na gruncie polskiego ustawodawstwa, a następnie omawia zastosowane rozwiązania prawne we Włoszech, Hiszpanii, Niemczech, Austria, Republice Czeskiej, Bułgarii, Szwecji, Danii, Finlandii, Anglii, Francji oraz na Węgrzech. Wybrane kraje posiadają zróżnicowane prawo w zakresie możliwości przeprowadzania badań, począwszy od restrykcyjnych zakazów, poprzez warunkowe dopuszczenie wykorzystywania embrionów bądź cybryd albo indukowanych pluripotencjalnych komórek macierzystych, a kończąc na wprowadzeniu do porządku prawnego kompleksowych uregulowań.
