The subject of the study is the treatment of PTSD with the use of MDMA as a method of counteracting the incidence of suicide. The discussion is carried out in the context of Polish law. The method used in the paper involves an analysis of the law in force, aided by M. Zieliński’s derivative concept of legal interpretation. The author of the study has established that: 1) PTSD may constitute a source of a threat to human life and health where persons might take their own lives; 2) PTSD can be successfully treated with MDMA; 3) Polish law does not allow the use of MDMA in the treatment of PTSD; 4) Polish law provides for criminal liability for possession of MDMA/ecstasy.

Przedmiotem pracy uczyniono problematykę leczenia PTSD z wykorzystaniem MDMA jako sposobu przeciwdziałania zjawisku samobójstwa. Rozważania w tym zakresie przeprowadzono na tle polskiego prawa. W pracy wykorzystano metodę dogmatycznoprawną. Zdecydowano się przy tym skorzystać z derywacyjnej koncepcji wykładni prawa autorstwa M. Zielińskiego. Autor pracy ustalił, że: 1) PTSD może stanowić źródło zagrożenia dla życia i zdrowia człowieka w postaci targnięcia się przezeń na własne życie; 2) PTSD może być skutecznie leczone z wykorzystaniem MDMA; 3) polskie prawo nie pozwala na wykorzystywanie MDMA w leczeniu PTSD; 4) polskie prawo przewiduje odpowiedzialność karną za posiadanie MDMA/ecstasy.

W niniejszym artykule przedstawiony został przypadek wystąpienia na nielegalnym rynku narkotykowym nietypowej postaci 3,4-metylenodioksymetamfetaminy (MDMA) w formie azotanu. Związek taki bardzo dobrze można zidentyfikować jedynie poprzez zastosowanie metod analitycznych, których nie wykorzystuje się rutynowo w badaniach kryminalistycznych tego typu substancji – elektroforezy kapilarnej (CE) czy skaningowej mikroskopii elektronowej (SEM). Należy więc być bardzo czujnym w przypadkach, gdy badania metodą chromatografii gazowej sprzężonej ze spektrometrią masową (GC-MS) jednoznacznie identyfikują badaną substancję, ale już badania w spektrofotometrii w podczerwieni tego nie potwierdzają.

The article presents a case involving an appearance of an atypical 3,4-methylenedioxymethamphetamine (MDMA) in the form of nitrate on the illicit drug market. This compound can be identified only by using such analytical methods as capillary electrophoresis (CE) or scanning electron microscopy (SEM), which are not routinely applied to forensic analyses of this type of substances. Therefore, particular caution should be exercised whenever a gas chromatography-mass spectrometry (GC-MS) method unambiguously identifies a substance, yet infrared spectroscopy fails to confirm this result.

The COVID-19 impact on the illegal retail drugs market in Latvia and drug use patterns

The purpose of the study is to explore how the COVID-19 situation has affected the illegal retail market and drug use patterns. Three research questions were formulated: 1) What has been the COVID-19 impact on the retail illegal drugs market? 2) How has the pandemic impacted drug use patterns? 3) Are there trends that presumably would have an impact after COVID-19? The mixed method with an explanatory sequential design was used in the analysis. At the first stage of the analysis all available quantitative data such as routine administrative data and data from regular surveys were analysed and triangulated. The results of quantitative analysis were supplemented by qualitative data, such as reports. The analysis does not suggest changes on the retail market, except for some increase in cannabis cultivation during the first wave in 2020 and a slight decrease in MDMA prevalence on the market in 2021. Drug use patterns are similar to those before the pandemic, with some exceptions that might indicate more cannabis and MDMA use among frequent users.
