Administrative penalty proceedings in the light of the proposed changes to the Fiscal Penal Code

This study explores the assumptions of the Bill of 13 April 2022 amending the Act – Fiscal Penal Code and Certain Other Acts in the scope of administrative penalty ticket proceedings conducted in cases of fiscal petty offences. The primary focus of the analysis is the presentation of the proposed changes (ultimately withdrawn) regarding the extension of the catalogue of bodies authorised to conduct administrative penalty proceedings to include the Municipal Police and the Trade Inspection Authority, and to define their competence. Furthermore, the article presents the positions submitted by various entities as part of public consultations on the draft in question. The publication concludes with the author’s evaluation of the currently applicable legal regulations concerning the issue under discussion.

Wypalenie zawodowe występuje powszechnie w każdej organizacji. Powszechne myślenie o wypaleniu zawodowym skoncentrowane jest na pracowniku i jego słabości w zakresie znoszenia trudności psychologicznych. Tymczasem syndrom wypalenia jest mocno związany ze stresogennym miejscem pracy i doświadczaniem przez pracownika chronicznego obciążenia emocjonalnego. Najczęściej występującymi skutkami organizacyjnymi wypalenia zawodowego są: konflikty w miejscu pracy, zaniedbywanie obowiązków, obniżenie wydajności i efektywności zawodowej, negatywne nastawienie do obywatela, współpracowników, pracodawcy oraz samej pracy, niewykorzystywanie wszystkich posiadanych kompetencji czy także częstsze nieobecności spowodowane stanem zdrowia. Dotychczasowe badania w zakresie wypalenia zawodowego prowadzone były w różnych służbach ale nie obejmowały pracowników straży miejskich. Mając na uwadze powyższe, celem niniejszego artykułu jest identyfikacja poziomu wypalenia zawodowego wśród strażników miejskich. Aby osiągnąć założony cel, w 2022 roku przeprowadzone zostanie badanie z wykorzystaniem kwestionariusza ankiety wśród 40 pracowników.

An important element of the local government model in Poland is undoubtedly the city guard functioning since the beginning of its restitution in Poland. The anniversary of the restoration of local government in Poland this year is an opportunity for many summaries and to draw conclusions for the future. While in the case of discussions on the functioning of local government in Poland, there is no search for voices that would say about an attempt to withdraw from local government reform, the postulate of liquidating municipal guards from the Polish public security system is increasingly appearing in public discussion. However, when discussing the legitimacy of the functioning of city guards, it is worth relying on source material, which clearly and clearly depicts the scope of its activities and thus illustrates its role in the public security system at the local level. The purpose of this study is primarily to characterize the activities of the individual in the years indicated, which prove the legitimacy of its existence in the provincial city, which is Poznań.

Istotnym elementem modelu samorządowego w Polsce jest niewątpliwie funkcjonująca od początku jego restytucji w Polsce straż gminna. Obchodzona w tym roku okrągła rocznica przywrócenia w Polsce samorządu terytorialnego jest okazją do wielu podsumowań i wyciągania wniosków na przyszłość. O ile w przypadku dyskusji na temat funkcjonowania samorządu terytorialnego w Polsce próżno poszukiwać głosów, które mówiłyby o próbie wycofania się z reformy samorządowej, o tyle w dyskusji publicznej coraz częściej pojawia się postulat likwidacji straży gminnych z polskiego systemu bezpieczeństwa publicznego. Warto jednak, dyskutując na temat zasadności funkcjonowania straży gminnych, oprzeć się na materiale źródłowym, który w jasny i klarowny sposób obrazuje zakres jej działań i tym samym opisuje pełnioną rolę w systemie bezpieczeństwa publicznego na poziomie lokalnym. Celem niniejszego opracowania jest przede wszystkim scharakteryzowanie działań jednostki we wskazanych latach, które świadczą o zasadności jej istnienia w mieście wojewódzkim, jakim jest Poznań.

W niniejszej pracy podjęto kwestię funkcjonowania administracji publicznej w Republice Czeskiej. Praca przedstawia analizę struktury i mechanizmów działania instytucji czeskiej administracji publicznej i czeskich samorządów. Nie tak dawno okazało się, że osoby, które podjęły szereg niewłaściwych decyzji – o charakterze i technicznym, i politycznym – zostały pociągnięte do odpowiedzialności. W pewnych przypadkach decyzje te zastosowano także wobec osób pełniących funkcje publiczne na wszystkich szczeblach. Badanie zawarte w pracy obejmuje przegląd norm obowiązujących obecnie w Republice Czeskiej oraz analizę ich zastosowania w praktyce decyzyjnej jednostek administracji terenowej.

This paper deals with the activity of the public administration of the Czech Republic. It analyses the structure and mechanisms of the functioning of the institutions of public administration and self-government of the Czech Republic. It appeared not so long ago that responsible persons were held accountable for wrong decisions – of both technical and political nature. In some cases, these decisions were also used against responsible persons at all levels. This research is based on the analysis of the present Czech legal norms and their application in the decisions made by local administration.

This study discusses the assumptions of the draft act of April 13, 2022 amending the Act – Fiscal Penal Code and some other acts in the scope of administrative penalty ticket proceedings conducted in cases of fiscal petty offences. The main stream of considerations is the presentation of the proposed changes (finally withdrawn) regarding the extension of the catalogue of bodies authorized to conduct administrative penalty proceedings to include the Municipal Police and the Trade Inspection Authority, and to define their competence. In addition, the article contains a presentation of the positions that were submitted by entities as part of public consultations on the draft in question. The publication ends with conclusions in which the author evaluates the currently applicable legal regulations regarding the title issue.

W niniejszym opracowaniu omówiono założenia projektu ustawy z dnia 13 kwietnia 2022 r. o zmianie ustawy – Kodeks karny skarbowy oraz niektórych innych ustaw w zakresie postępowania mandatowego prowadzonego w sprawach o wykroczenia skarbowe. Główny nurt rozważań stanowi przedstawienie projektowanych zmian (finalnie wycofanych), a dotyczących poszerzenia katalogu organów uprawnionych do prowadzenia postępowania mandatowego o straż gminną i Inspekcję Handlową oraz określenia ich właściwości. Ponadto artykuł zawiera prezentację stanowisk, które zostały zgłoszone przez podmioty w ramach prowadzonych konsultacji publicznych nad omawianym projektem. Publikację kończą wnioski, w których Autorka ocenia obecnie obowiązujące uregulowania prawne w zakresie tytułowego zagadnienia.
