The article presents theory of spontaneous order well-developed and promoted by Friedrich August von Hayek. According to him, the majority of human social institutions, such as 'inter alia' law, language and money was not created as a result of deliberate plan, but evolved spontaneously. For Hayek all conscious and planned attempts to reduce spontaneous social phenomena show the pride of human mind and therefore lead only to disrupt the proper functioning of the community. In fact, the more complex social order, the lower the possibility of conscious control and purposeful organization. Conscious control of social processes leads inevitably to the collapse of law understood as 'the rule of law' and leads us straight to the law understood as an instrument of control over society

This paper focuses on theoretical analysis of the notion of constructed order (as described by Walter Eucken) against the background of the current economic crisis. The choice of topic is justified by the increasingly evident weaknesses of modern capitalist economy. The literature on the subject points out with growing frequency that the market system should not be allowed to act alone and requires active support, as well as corrective action on the part of the state. These ideas seem to overlap with the premises of Eucken's concept of constructed order, in which the state ensures self-regulation of market economy on a general scale, and guarantees conditions conducive to the realisation of social values.

There are two different traditions of thinking about social and political life which are represented by the concepts of taxis and kosmos. According to the first of them we should trust in the human mind because it can design and put in practice a suitable social order. Conversely, in the opinion of the latter tradition, we should appreciate that a spontaneous order comes into existence as a result of free decisions of particular individuals who are not realizing any general plan. Hayek belongs to this tradition, pointing out the beneficent effects of voluntary cooperation. The individuals take part in what they cannot design and make happen, but thanks to their free participation they build a good society and a just state. Hayek’s position shows a naïve faith in the power of spontaneous human activity because people can choose also, in the voluntaristic paradigm, slavery. Because of this propensity of spontaneous human activity, it is incumbent upon political authority, for the common good and more equality, to restrict an excessive freedom. In the way proposed by Hayek, what in fact comes into existence is a welfare state, a state which spouts the slogans of social justice, a state which in Hayek’s own opinion, is actually an instrument of serfdom.

The author discuses research knowledge in the field of theory of economic cycles, competitive entrepreneurial potentials, innovation dynamics, rational development and spontaneous order of productive systems (firms). The presented approaches to given issues are supported by works of other scholars in related fields. At the same time it introduces unpublished thoughts of theoretical and applied character. By using logical instruments author come up to a dilemma of “relative and golden section” of productive system evolution. “Relative and golden sections” occur in various objects and processes in different moments in time and even though they are related and implicate each other. It is necessary to emphasize the eclectic and syncretistic approach in the science methodology, social science in particular. In finding of harmony in diversities, unity in contrasts, quality in quantity, the beginning of the novel in the destruction of the old, the effect in potential, macro economical world in microeconomics and vice versa, etc., is the foundation of the new insight, that should be brought into economics, management theory or business.
