Artykuł ma na celu zilustrowanie problemów prawnych wynikających na gruncie art. 35 Karty Nauczyciela w obecnym brzmieniu. Autor przedstawia zakres przedmiotowy i podmiotowy instytucji pracy w godzinach ponadwymiarowych, jej charakter prawny oraz ewentualne konsekwencje naruszenia tych przepisów dla pracodawcy.

The aim of this paper is to illustrate the legal issues which result from the application of art. 35 of the Polish Teacher Charter in its current wording. The author presents the objective and subjective scope of the institution of working overtime hours, its legal nature and sanctions for violations of these legal provisions by an employer.
