Since 1 January 2021, the new regulations on public procurement have been in force in Poland, also related to public procurement auditing. Audit bodies obliged to use the provisions introduced have been clearly defined and numerous responsibilities have been imposed on them. The solutions adopted are aimed, in the first place, to increase the effectiveness of auditing and to eliminate discrepancies in the law application by various bodies. These assumptions are to be achieved through the principles that stem from the new provisions: cooperation of audit bodies, planning and coordinating audits on the basis of risk analysis as for the probability of law breaches, conducting audits on the basis of applicable questionnaires, basing negative audit results on the irregularities disclosed that have an impact on the proceedings results, and publicising audit findings. NIK is not subject to the new provisions, yet the practices related to these regulations may be successfully used in the measures aimed at increased effectiveness and efficiency of NIK in the area of public procurement auditing.

Nowe regulacje dotyczące kontroli, wprowadzone na mocy obowiązującej od 1 stycznia 2021 r. ustawy z 11 września 2019 r. – Prawo zamówień publicznych1, mają zwiększyć ich efektywność i wyeliminować rozbieżności interpretacyjne w stosowaniu prawa przez różne organy. Urzeczywistnieniu tych postulatów posłużą wynikające z przepisów ustawy zasady: współpracy organów kontroli, jej planowania i przeprowadzania na podstawie analizy ryzyka prawdopodobieństwa naruszenia prawa oraz stosownych kwestionariuszy, oparcia negatywnej oceny na stwierdzonych nieprawidłowościach, mających wpływ na wynik postępowania oraz upubliczniania wyników. Nowe przepisy nie dotyczą wprost Najwyższej Izby Kontroli, można jednak zakładać, że będą wpływać na jej praktykę.
