In this paper we focus on an adverse effect of extensive choice widely known as ‘choice overload’. We draw on the case of Swedish funded pensions for illustration and analyze the consequences of the design that allowed for maximizing the choice set. The analysis shows limitations of employing the rational choice approach to the real choice decisions biased with common psychological factors and demonstrates that government’s responsibility for the privatized pension system does not end with the design. We also emphasize the need for a decent default option, which would mitigate socially harmful results of adverse behavior effects like procrastination, status quo bias or abstaining from choice. After all, privatized pension systems still belong to the sphere of public policy.

The develoment of sustainable consumption should be considered nowadays a major challenge for public policy. A number of instruments,including legal, administrative, economic and information ones are used to enhance sustainable consumption. In recent years, the development of research in the field of behavioral economics has pointed at the possibility of identifying another group of instruments, namely behavioral tools, including consumer choice architecture, so that they promote the implementation of the concept of sustainable consumption. Choice architecture is based on the use of the so-called nudging tools, which constitute a change in the context of consumer decision-making. The purpose of the study is to investigate the use of choice architecture in creating sustainable consumption by influencing the decision context of individuals and households. The paper uses the method of critical literary analysis. Its results have shown the existence of a substantial amount of empirical evidence on the applicability of choice architecture in the process of promoting sustainable consumption. On the other hand, the analysis has also indicated a number of limitations to their implementation. This, in turn, has led to the conclusion that behavioral instruments for increasing sustainable consumption (using the natural tendency of individuals in decision-making processes) can complement the traditional instruments, including direct effects.

Celem niniejszego opracowania jest analiza argumentu zdrowia publicznego w kontekście debaty nad legalizacją miękkich narkotyków. W pierwszej części przybliżona zostaje treść pojęć, które występują w kontekście prezentowanego tematu. Na dalszych stronach przedstawiona zostaje analiza pojęcia zdrowia publicznego występującego w terminologii prawniczej. Analiza funkcjonowania tego pojęcia oraz argumentów budowanych na jego podstawie prowadzi do wniosku, że argument ze sfery zdrowia publicznego w dyskusji nad legalizacją miękkich narkotyków jest mało przekonywający oraz brakuje mu solidnej teoretycznej podbudowy. Mimo to zdrowie publiczne wciąż pozostaje jednym z najczęściej podnoszonych argumentów w dyskursie narkotykowym, w ostatniej części pracy – w oparciu o badania J. Haida z zakresu psychologii moralności − przedstawione zostaje możliwe wyjaśnienie faktu, dlaczego argument ze sfery zdrowia publicznego cieszy się nieustającą popularnością.

The purpose of the present text is to provide analysis of the public health argument in the context of the debate over legalisation of soft narcotics. The first part provides an explanation of the terms used, followed by an analysis of the term ‘public health’ in the legal terminology. The analysis of this termand the arguments built on that basis leads to a conclusion that the public health argument in the discussion about legalisation of soft narcotics is little convincing and lacks a sound, theoretical basis. Despite the fact that public health remains among the arguments most often raised in the narcotics discourse, in the final part of this work – drawing on the study of J. Haid in the area of psychology of morality – a possible explanation is presented as to why the argument of public health remains popular.
