A notary is liable for damages caused while performing notarial acts, which constitutes tort liability. At the same time, to ensure protection for injured parties, the legislator has introduced mandatory civil liability insurance for notaries for damages caused during the performance of notarial acts. The injured party has the right to choose the entity from which they will seek compensation in the legal process, with the proviso that the lawsuit may also be filed against both entities jointly. Pursuing compensation claims by the injured party from both the notary and the insurer results in co-participation in the dispute on the part of the defendants.
