Current state of the doctrine and the main tendencies of development of constitutional justice in Ukraine are analyzed in the article. The dilemma and main factors of introduction of the constitutional justice in the state structure of Ukraine, the contradictory elements of which laid some problems in the implementation of the rule of law, respect for human rights and democracy are revealed. The main tendencies of the development of constitutional justice in the light of the constitutional reform of justice and the adoption of a new version of the Law on the Constitutional Court are defined. Special attention is paid to the introduction of the institution of constitutional complaint and the system of legal protection of human rights in Ukraine.

According to the Constitution or laws, individuals today have extensive political rights closely associated with the right to vote. Here is meant the active and passive right of voting. Membership in a party is not only because of the desire, but also for the fact that the party gives individuals the possibility of career progress, further realization of their political rights. The purpose of this paper is to present the development of political parties and individual rights, not only in Albania, but also combined with the European experience. In this paper we will focus on how political parties have evolved as well as the political rights of individuals after the independence in 1912. The development of political parties in Albania has passed in two stages in the communist system where only one party was known and in the democratic system where was recognized political pluralism. Highlighting the role of political parties, as an important promoter of the functioning of state and of the coverage of the political rights of individuals, makes this study important.

ECHR, as an international treaty is part of the Albanian legal system. Among international law instruments, the ECHR enjoys a privileged status in the Albanian legal system by virtue of Article 17 paragraph 2 of the Constitution according to which restrictions to human rights and freedoms cannot infringe the substance of those rights and freedoms and in no case can exceed the restrictions provided for in the ECHR. Article 1 of the Convention requires States to secure the substance of the rights to those in their jurisdiction. The effect of Article 13 is thus to require the provision of a domestic remedy to deal with the substance of an arguable complaint under the Convention and to grant appropriate relief. The scope of this paper is to analyse the effectiveness of the complaint to the Constitutional Court with regard to length of proceedings as part of due process of law in terms of proceedings during the court trial and after the process has been finalized and the final decision should be executed.

The article is devoted to the historical evolution and modern development trends of the Constitution of Poland. It provides the general characteristics of formation and development of the Republic of Poland. It is emphasized that Poland is the earliest explorer of the European constitutionalism. Since 1791 in the constitutional history of Poland were approved the nine constitutional documents. In addition, consideration is given to such historical constitutions as the Constitution of May 3, 1791, the Grodno Constitution of November 23, 1793, the Lower Constitution of February 20, 1919, the March Constitution of 1921, the Constitution of 1935, the Constitution of the Peoples’ Republic of Poland of 1952, the Constitution of 1976, the present Constitution of 1997. The article reveals the main features of the present Constitution and characterizes contemporary constitutional system of Poland.

Статья посвящена исторической эволюции и современным тенденциям развития польской Конституции. В ней дается общая характеристика становления и развития Республики Польши. Особо отмечается, что Польша является первопроходцем европейского конституционализма. В польской конституционной истории принято, начиная с 1791 г., девять конституционных актов. Рассматриваются такие исторические Конституции Поль-ши как Конституция 3 мая 1791 г., Гродненская Конституция (23 ноября 1793 г.), Малая Конституция (20 февраля 1919 г.), Мартовская Конституция (1921 г.), Конституция (1935 г.), Конституция ПНР (1952 г.), Конституция 1976 г., действующая Конституция 1997 г. Выявлены основные особенности действующей Конституции и характеризуется современная конституционная система Польши.

In the second part of the article, the author discusses the procedure for recognizing normative acts as unconstitutional - which is the basis for claiming compensation from the state treasury for damages caused by the application of these unconstitutional normative acts and regulations based on the provisions of substantive civil law. When analyzing the content of the regulations regarding the COVID-19 epidemic, the author reviews the regulations that raise doubts in the doctrine as to their constitutionality. He also notes the inconsistency of these provisions with the legal system. Finally, the problem of possible compensation of the state treasury for damages caused by the legal activities of public authorities is discussed.

W drugiej części artykułu autor omawia procedurę uznawania aktów normatywnych za niekonstytucyjne – co stanowi podstawę do dochodzenia odszkodowania od Skarbu Państwa za szkody spowodowane przez stosowanie tych niekonstytucyjnych aktów normatywnych i przepisów w oparciu o przepisy materialnego prawa cywilnego. Analizując materię przepisów dotyczących epidemii COVID-19, autor dokonuje przeglądu przepisów budzących wątpliwości w doktrynie co do ich konstytucyjności. Zauważa również niespójność tych przepisów z systemem prawa. Na koniec poruszony zostaje problem ewentualnych odszkodowań Skarbu Państwa za szkody spowodowane legalnym działaniem organów publicznych.
