Znaczenie dopełnienia małżeństwa naturalnego, czyli (jeszcze) niesakramentalnego

Canon 1142 Code of Canon Law indirectly introduces the category of consummation of natural marriage, which is not yet sacramental. This article attempts to present the anthropological meaning of this consummation using John Paul II’s analyzes contained in his theology of the body. The consummation of marriage is an act that may be called by the biblical term of „one flesh”. This act is characterized by anthropological terms: „knowledge”; „reaching the end of the objectivity of the body” and „possession”. Showing the content of these terms leads to the conclusion that the meaning of consummation of natural marriage is deeply personalistic and allows for a deeper understanding of what is the subject of the marriage consensus, i.e. the marriage bond.

Kanon 1142 KPK wprowadza pośrednio kategorię dopełnienia małżeństwa naturalnego, które nie jest jeszcze sakramentalne. Niniejszy artykuł próbuje przedstawić antropologiczne znaczenie tego dopełnienia, posługując się analizami Jana Pawła II zawartymi w jego teologii ciała. Dopełnienie małżeństwa jest aktem, który można nazwać biblijnym terminem „jednego ciała”. Charakteryzują ów akt antropologiczne terminy: „poznanie”, „dojście do kresu przedmiotowości ciała” oraz „posiadanie”. Ukazanie treści tych terminów prowadzi do konkluzji, że znaczenie dopełnienia małżeństwa naturalnego jest głęboko personalistyczne i pozwala na głębsze zrozumienie, czym jest przedmiot małżeńskiego konsensu, czyli małżeński węzeł.

In the presented article, the subject of the Author’s attention became the designator of the normative phrase humano modo, appearing in can. 1061 § 1 of the Code of Canon Law 1983. The author is of the opinion that the meaning of this phrase cannot be understood without taking into account a broader context related, on the one hand, to the evolving perception of the matrimonial act in canonistics and, on the other hand, to the assumptions of the theory of the legal act. He showed that the consummation of marriage has the character of a bilateral legal act. In his opinion, the meaning of the phrase humano modo remains in close connection with the personalistic vision of the matrimonial act related to the category of a human act (actus humanus). He expressed the view that the application of the assumptions of the theory of the legal act on the subject of its defects (violence, fear, malice) became a stimulus for a deeper reflection of the doctrine on the issue of conjugal living in the canonical legal order.

W prezentowanym artykule przedmiotem uwagi Autora stał się desygnat zwrotu normatywnego humano modo, występującego w kan. 1061 § 1 Kodeksu prawa kanonicznego z 1983 roku. Autor jest zdania, że znaczenia tego zwrotu nie można zrozumieć bez uwzględnienia szerszego kontekstu związanego z jednej strony z ewoluującym postrzeganiem aktu małżeńskiego w kanonistyce, a z drugiej strony z założeniami teorii czynności prawnej. Wykazał, że skonsumowanie małżeństwa ma charakter dwustronnej czynności prawnej. Jego zdaniem znaczenie zwrotu humano modo pozostaje w ścisłym związku z personalistyczną wizją aktu małżeńskiego, związaną z kategorią aktu ludzkiego (actus humanus). Wyraził pogląd, że zastosowanie założeń teorii aktu prawnego na temat jego wad (przemoc, bojaźń, złośliwość) stało się impulsem do głębszej refleksji doktryny nad zagadnieniem pożycia małżeńskiego w kanonicznym porządku prawnym.
