The study tackles the worker’s protection under the purview of criminal and civil laws from harassment in the workplace. The researchers point out that the UAE legislator has not addressed moral harassment in the workplace either in the Penal Law or in the Regulation of Labor Relations. Meanwhile, the French legislator criminalizes moral harassment acts in the French Penal Law and regulates that in the respective labor law. This motivates us to examine this subject with sights set to have this study as a proposal for the UAE legislator to draft provisions that criminalize moral harassment in the workplace. This study provides the punishment prescribed for this crime. It also describes this act in the Labor Law to determine the procedures set to protect the victims from harassment, to empower them to receive fair compensation, and to prevent the employer from harassing workers to push them to abandon work.

This article deals with the issue of criminal law protection of the possibility of associating in trade unions, regulated in the Act on Trade Unions. First, the importance of the freedom to form a trade union and the right to join it was noted. Successively, behaviors that violate the sanctioned norms protecting these values were identified, and then other elements of the structure of the crime - that condition criminal liability for violation of these rights were analyzed. Finally, existence and the scope of this protection was assessed taking into account the importance of these values for the protection of workers' rights, and de lege ferenda conclusions were put forward in this context.

Autorka omawia kwestie związane z prawnokarną ochroną możliwości zrzeszania się w związki zawodowe uregulowaną w ustawie o związkach zawodowych. Zwraca uwagę na istotne znaczenie wolności utworzenia związku zawodowego i prawa przystąpienia do niego, wskazuje zachowania, które stanowią naruszenie norm sankcjonowanych chroniących te wartości, oraz analizuje pozostałe elementy struktury przestępstwa warunkujące odpowiedzialność karną za naruszenie tych praw. Na tym tle ocenia zarówno istnienie jak i zakres tej ochrony, z uwzględnieniem znaczenia wymienionych wartości dla ochrony praw pracowniczych, oraz formułuje wnioski de lege ferenda.
