The article discusses a new regulation which allows parents to disclaim the inheritance in the name of their child without a consent of a family court (the new Art. 101 § 4 of the Polish Family and Gu-ardianship Code). This new possibility depends on several conditions, that is: (1) the child is appo-inted as an heir due to the prior disclaimer of the inheritance by his parent; (2) other descendants of that parent also disclaim the inheritance; (3) both parents agree on the disclaimer. The text examines all these premises focusing on the most controversial questions troubling the notarial praxis.
